Prosecutions & Enforcement
I am very experienced in defending criminal prosecutions and applications for enforcement orders under the Resource Management Act 1991 and other environmental legislation.
Some of my recent work includes:
- Defended director and earthworks company, A H Construction Services Ltd, against criminal prosecution for unearthing a landfill containing asbestos and contaminating surrounding environment during a major commercial and industrial construction project. Auckland City Council v A H Construction Services Ltd  (EC).
- Defended directors and development company, Fieldlaw Ltd, against criminal prosecution for contaminating the coastal marine area during a residential construction project. Auckland Regional Council v Fieldlaw Ltd.
- Defended Southern L C Limited against an application for ex parte interim enforcement orders by Queenstown Lakes District Council to cease operation of a cement works until noise levels abated. Queenstown Lakes District Council v Southern L C Ltd.
